Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Used Project website located at usedproject.com ("the Site", "we", "us", "our"). By accessing the Site, creating an account, submitting content, or using any feature of the Site, you agree to be legally bound by these Terms and our Privacy Policy, which is incorporated by reference.

We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated date. Your continued use of the Site following any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

Used Project is an online directory that lists antique stores, op shops, vintage boutiques, collectables dealers, and second-hand retailers across Australia. The Site allows users to browse listings, create accounts, manage profiles, and communicate with other registered users via an internal messaging system.

Used Project is a directory and information service only. We are not a marketplace, we do not facilitate transactions, and we do not represent, endorse or act as agent for any business listed on the Site.

You must be at least 15 years of age to create an account or use the features of this Site. By registering, you represent that you meet this requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the Site.

You must be a natural person using the Site for lawful purposes. Automated accounts, bots, scrapers and non-human access are prohibited without our prior written permission.

To access certain features of the Site, you may be required to register for an account. You agree to:

• Provide accurate, current and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with any third party.
• Notify us immediately of any unauthorised use of your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate any account at our sole discretion, without notice, for any breach of these Terms or for any other reason we consider appropriate, including but not limited to inactivity, abusive conduct, or misuse of the platform.

By using the Site you agree not to:

• Post, transmit or share content that is unlawful, defamatory, harassing, threatening, abusive, hateful, discriminatory, obscene or otherwise objectionable.
• Impersonate any person or entity or falsely represent your affiliation with any person or entity.
• Use the messaging system to send unsolicited commercial communications (spam).
• Attempt to gain unauthorised access to any part of the Site, other user accounts, or systems connected to the Site.
• Use the Site to collect personal information about other users without their consent.
• Interfere with or disrupt the operation of the Site or servers or networks connected to the Site.
• Upload or transmit viruses, malicious code, or any other harmful software.
• Use the Site in any manner that could damage, disable, overburden or impair the Site.
• Violate any applicable local, state, national or international law or regulation.
• Use the Site for any commercial purpose not expressly permitted by us.

The Site may allow you to submit, post or share content including profile information, store listings, messages and other material ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content.

By submitting User Content to the Site, you grant Used Project a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, adapt, publish and display that content in connection with operating and promoting the Site.

You represent and warrant that:

• You own or have the necessary rights to submit the content.
• The content does not infringe the intellectual property rights, privacy rights or other rights of any third party.
• The content is accurate and not misleading.

We do not endorse, verify or take responsibility for any User Content. We reserve the right (but not the obligation) to remove any User Content at our sole discretion and without notice.

Used Project contains listings for businesses across Australia. Many listings are sourced from publicly available information and have not been independently verified. We make no representations or warranties as to the accuracy, completeness, currency or reliability of any listing on the Site.

Business information including hours, addresses, phone numbers, websites and descriptions may be out of date, incorrect or incomplete. You should independently verify any information before relying on it. Used Project accepts no liability for loss or damage arising from your reliance on listing information.

If you are a business owner and wish to claim, update or remove your listing, please contact us. We will make reasonable efforts to action legitimate requests in a timely manner.

The messaging system is provided as a convenience feature for users of the platform. By using the messaging system you agree not to use it to send spam, harassment, illegal content, or unsolicited commercial communications.

We do not actively monitor private messages but reserve the right to access, review and disclose message content where we reasonably believe it is necessary to investigate abuse, comply with legal obligations, or protect the rights and safety of users or third parties.

We are not responsible for the content of messages sent between users and accept no liability for any loss, harm or dispute arising from user-to-user communications conducted through the platform.

All content on the Site that is not User Content — including the design, layout, graphics, logos, text, software and code — is owned by or licensed to Used Project and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Site without our prior written permission, except as permitted by law or as expressly authorised by these Terms.

The Site may contain links to third-party websites, services or resources. These links are provided for convenience only. We have no control over the content, privacy practices or availability of those third-party sites and are not responsible for any loss or damage arising from your use of them.

The inclusion of a link does not constitute endorsement by Used Project of the linked site or its operator.

The Site and all content, features and services are provided on an "as is" and "as available" basis without any warranties of any kind, whether express, implied or statutory.

To the fullest extent permitted by applicable law, Used Project expressly disclaims all warranties including but not limited to:

• Warranties of merchantability, fitness for a particular purpose and non-infringement.
• That the Site will be uninterrupted, error-free, secure or free from viruses or harmful components.
• That any information on the Site is accurate, complete, reliable, current or suitable for your purposes.
• That defects will be corrected.

Nothing in these Terms excludes any rights or guarantees you may have under the Australian Consumer Law that cannot be excluded by agreement.

To the maximum extent permitted by Australian law, Used Project and its operator shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages arising out of or in connection with your use of the Site, including but not limited to:

• Loss of profits, revenue, data or goodwill.
• Business interruption.
• Personal injury or property damage.
• Unauthorised access to or alteration of your data or transmissions.
• Conduct or content of any third party on the Site.
• Any reliance placed on information contained in listings or user-generated content.
• Any loss arising from a data breach, security incident or unauthorised access to the Site's systems, except to the extent such liability cannot be excluded under Australian law.

Where liability cannot be fully excluded under applicable Australian law, our total aggregate liability to you for all claims combined arising from your use of the Site is limited to the amount actually paid by you to Used Project in the 12 months preceding the claim. As Used Project is a free service, this amount will in virtually all cases be AUD $0. You acknowledge and accept this limitation as a fundamental condition of your use of the Site.

You expressly agree that use of the Site is entirely at your own risk. If you do not accept this limitation, your sole remedy is to discontinue use of the Site.

You agree to fully indemnify, defend at your own expense, and hold harmless Used Project, its operator, and any associated persons from and against any and all claims, liabilities, judgments, damages, losses, costs, and expenses (including actual legal fees on a solicitor-client basis) arising out of or relating to:

• Your use of the Site.
• Your User Content.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any dispute between you and another user of the Site.

While we take reasonable steps to secure the Site and its infrastructure, no online platform can guarantee immunity from cyberattack, data breach or unauthorised access. In the event of a security incident affecting your personal information, we will comply with our obligations under the notifiable data breach scheme in the Privacy Act 1988 (Cth).

Used Project accepts no liability for damages arising from security incidents, cyberattacks, hacking, unauthorised access, or other malicious acts by third parties beyond our reasonable control.

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice and without liability or compensation to you, for any reason or no reason, including but not limited to violation of these Terms, conduct we deem harmful to other users or the platform, or inactivity. You have no right to continued access to the Site.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Site ceases immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability and indemnification — will continue to apply.

These Terms are governed by the laws of Australia and the State of New South Wales. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Mandatory informal resolution: Before initiating any formal legal proceedings, you must first contact us in writing and allow us a period of not less than 60 days to attempt to resolve the dispute informally. Failure to comply with this requirement is a complete bar to any formal proceeding.

Class action waiver: You agree that any dispute must be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated or representative action. You expressly waive any right to bring or participate in a class action of any kind against Used Project.

Limitation period: Any claim arising from your use of the Site must be brought within one (1) year of the date the cause of action arose, regardless of any statute of limitations that might otherwise apply. Claims not brought within this period are permanently barred.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Used Project regarding your use of the Site and supersede any prior agreements, representations or understandings.
